1. Definitions

   In these general terms and conditions, the following terms are used:

   1.1 Contractor: Helcity Piercing 

   1.3 Agreement: Any agreement between Helcity Piercing and the Client to provide services, including having a piercing placed.

  1.2 Client: The natural person who gives an order to Helcity Piercing to have a piercing done.

1. Applicability

   2.1 These General Terms and Conditions will apply to all agreements between Helcity Piercing and the Client whereby Helcity Piercing acts as a (potential) supplier of services and products. Deviation from these General Terms and Conditions is only possible in writing and with Helcity Piercing's express consent.

   2.2 All deliveries of piercings by Helcity Piercing were delivered without any exceptions by artists from Helcity Piercing.

   2.3 The Client who enters into an Agreement with Helcity Piercing expressly agrees to these General Terms and Conditions used by Helcity Piercing.

2. Own Responsibility and Own Risk

   3.1 All tasks from the Contractor to Helcity Piercing were given under own responsibility and at the risk of the Client.

   3.2 By ordering Helcity Piercing to perform a piercing, the Client declares to be familiar with all possible consequences of the treatment, including medical, psychological, and social consequences. The Client is aware that body adornments applied by Helcity Piercing can never be removed completely or in a cosmetically appealing way be removed.

   3.3 By ordering Helcity Piercing to perform a piercing, the Client also declares that he/she is in good health, does not suffer from any form of allergy, hemophilia, diabetes, immune disorder, skin condition or otherwise, and is not infected with blood-borne diseases (such as HIV, hepatitis A, B or C or otherwise) and that his/her treatment can also not in any way endanger the health of Helcity Piercing or third parties.

   3.4 The Client warrants that he/she is the age of 16 years or older and has made his/her decision to have a piercing done by Helcity Piercing in a well-considered manner.

   3.5 Helcity Piercing places NO piercings on people who are under the age of 18, from 16 to 18 years ONLY Accompanied by at least one parent or legal guardian. In this case, at least one of the parents must fill out and sign our consent form, and bring their ID card. From 18 years onwards valid ID card REQUIRED.

   3.6 Helcity Piercing doesn't treat people who are under the influence of drugs or alcohol.

   3.7 Helcity Piercing always has the right to ask the contractor to show a valid ID, which can be copied and stored. In the case of the Contractor not showing a valid ID, Helcity Piercing has the right to deny the Contractor.

3. Payment

   4.1 The amount to be paid is based on the total amount of the session(s).

4. Liability

   5.1 By placing an order with Helcity Piercing, the Client acknowledges that Helcity Piercing has an obligation of effort. Helcity Piercing will make every effort to achieve the intended result. Helcity Piercing can never guarantee that the intended result will actually be achieved. Helcity Piercing will not be liable for not achieving or not fully achieving the intended result, nor for damage that could occur as a result of treatment, unless it is established that the damage is due to its intention or gross negligence.

   5.2 Should Helcity Piercing be found liable for any damage suffered by the Client, compensation will be limited to the amount that Helcity Piercing has charged the Client for the relevant delivery of products or services.

   5.3 Any right to compensation will in any case lapse if the Client has not taken measures immediately after the occurrence of the damage to limit the damage or to prevent more or other damage, and has not informed Helcity Piercing as soon as reasonably possible of all relevant information in this regard.

   5.4 Helcity Piercing stipulates all statutory and contractual defenses, which it can invoke to defend its own liability to the Client, also on behalf of any third parties for whose conduct it would be liable pursuant to the law.

5. Warranty
   Helcity Piercing only uses products to pierce which have been controlled strictly under the control of the Ministry of Public Health.

6. Applicable Law
   7.1 These General Terms and Conditions, as well as all agreements to which the General Terms and Conditions apply or are partly applicable, are governed by Belgian law.

7. Conversion
   In the case when no appeal can be made to any provision in these general terms and conditions on the grounds of reasonableness and fairness or its unreasonably onerous nature, that provision will be accorded a meaning corresponding as far as possible to its content and purport, so that an appeal can be made to it.

8. Final Provision
   The placing of a piercing by Helcity Piercing happens completely at one's own risk, as mentioned on our required to fill out consent formula.
